New Hampshire Speedway executive vice president and general manager Jerry Gappens was arrested last week with indecent exposure and a misdemeanor charge of lewdness.

According to a police report, Gappens was engaged in sexual activity with a 19-year-old prositute named Kendra Johnson inside a car.

According to police working a prostitution detail, they saw the 53-year-old Gappens drive his white Toyota Sequoia toward the prositute. She got into his vehicle about 5:45 p.m. on Jan. 21, police Sgt. Chris Biron said, via the New Hampshire Union Leader. Gappens then drove to the rear of the parking lot of a Manchester nursing home, where police approached the vehicle after seeing movement in the back seat. That's when a detective saw the two "engaged in a sexual act," Biron said.

His attorney released a statement to News 9 in Manchester, N.H.

"Mr. Gappens acknowledges using poor judgment that has resulted in a misdemeanor charge that is both embarrassing and devastating to him and his family, and for that, he sincerely apologizes," the statement says. "He regrets his actions. While he made a bad decision, he did not, in my opinion, engage in conduct that violates the referenced statute or any other criminal law. Mr. Gappens cooperated fully with the police, and we hope to have this difficult situation resolved soon."

Gappens, who is married and has three children, has been in his current position since 2008.
